1. Scope and Definitions
1.1 These Terms of Use govern the use of the platform for job search, career support and coaching (collectively the “Service”) operated by Senior Connect GmbH (“Senior Connect”, “we”) by consumers within the meaning of Section 13 of the German Civil Code (BGB) (hereinafter “User”/“you”).
1.2 For business customers (B2B), only Senior Connect’s General Terms and Conditions apply. These Terms replace any previous terms for applicants.
1.3 Conflicting terms and conditions of the User shall not apply.
2. Subject Matter & Service Description
2.1 The Service supports users in career transition by means of AI-powered job matching, optimization of application documents, interview training as well as mentoring/coaching.
2.2 Service packages
Free (“Always Free”): Access to job matches (DE), personal contact (email), basic profile.
Basic (paid): Additionally, enhanced document optimization and unlimited AI interview training (fair-use, see sec. 7.4).
Premium (paid): Additionally, 1:1 career mentoring session (45 min/month).
2.3 No employment placement owed. We do not owe any hiring or placement success. Recommendations and matches are suggestions based on the data you provide and our market analysis.
3. Registration & Account
3.1 An account is required for use. Registration is done via our website.
3.2 You provide truthful information, keep access data confidential and inform us immediately in case of suspected misuse.
3.3 You must be at least 18 years old.
3.4 As part of the Service, we inform you by e-mail about suitable job offers and relevant status updates. Legal basis: contract performance (Art. 6 (1) (b) GDPR).
You can deactivate job alerts at any time via email. We do not send advertising for third-party offers without your prior consent.
4. Contract Conclusion via Online Checkout (Button Solution)
4.1 Package presentations are non-binding offers. By clicking the final button “order with payment obligation”, you submit a binding order.
4.2 We confirm receipt by email. The contract is formed by our acceptance (separate email) or by commencement of service delivery.
5. Prices, Terms, Renewal, Termination
5.1 Prices: All package prices are final prices in EUR incl. VAT. Introductory/promotional prices are shown separately.
5.2 Terms
Free: Unlimited, cancellable anytime.
Basic / Premium: Minimum term of 1 month from contract conclusion.
5.3 Renewal: After minimum term, paid packages continue indefinitely with monthly billing; you may cancel anytime effective at month-end.
5.4 Termination: In text form via email to kontakt@senior-connect.de. We send electronic confirmation with termination date.
5.5 Payment: Monthly in advance by available payment methods (e.g. SEPA direct debit, credit card, PayPal). In case of payment default, access may be temporarily suspended; statutory rights remain unaffected.
5.6 Price changes only affect future billing periods. Notice at least 6 weeks before effective date; special right of termination applies.
6. Right of Withdrawal (Consumers)
Withdrawal Policy
You have the right to withdraw from this contract within 14 days without giving any reason. The period begins upon conclusion of the contract.
To exercise your right, notify us (Senior Connect GmbH, Obereichenrot 8, 74575 Schrozberg, email: kontakt@senior-connect.de) by means of an unambiguous declaration (e.g., email). You may use the model form (Annex A), but it is not mandatory.
Effects of Withdrawal
If you withdraw, we will refund all payments without undue delay and at the latest within 14 days of receipt of the withdrawal notice, using the same payment method as for the original transaction.
Start of services before expiry of withdrawal period
For paid digital services, we ask you during checkout to expressly agree to immediate performance and acknowledge that the withdrawal right expires once the service is fully provided. If you requested performance during the withdrawal period and later withdraw, you must pay a reasonable amount for services provided up to the withdrawal.
7. Scope of Services, Fair Use & Booking
7.1 AI Job Matching (DE): Based on profile, preferences and market sources; relevance may vary.
7.2 Document Optimization: Creation/optimization of professional application documents. Included: 1 basic set per 1-month minimum term (CV + AI interview trainer). Additional iterations based on package availability.
7.3 Premium Mentoring: 1:1, 45 min/month. Bookable via our calendar; cancellations free of charge up to 48 hours before. Missed sessions expire.
7.4 Unlimited AI Interview Training (Fair-Use): “Unlimited” means without fixed cap but in line with typical individual usage. Misuse/automated heavy load or mass concurrent sessions prohibited. Sustained usage above the 95th percentile may be temporarily restricted.
7.5 No legal/tax/medical/financial advisory outcome. Mentoring is career sparring; decisions remain the user’s responsibility.
8. Availability & Maintenance
8.1 We strive for high availability. Planned maintenance, where possible, outside peak times with notice; in urgent cases notice may be omitted.
8.2 Third-party services (e.g., video conferencing, hosting, AI providers) may cause temporary limitations.
9. User Obligations & Prohibited Use
9.1 Use only in accordance with the contract and for personal purposes.
9.2 Prohibited: unlawful content, security breaches, automated scraping, resale/sharing of paid content, circumventing access controls.
9.3 User content: You grant us a simple right to store, process and provide user content during the contract term. You ensure no third-party rights are violated and indemnify us accordingly.
10. Rights to the Platform
10.1 All rights to the Service, software, content and trademarks remain with Senior Connect or licensors.
10.2 Reverse engineering, decompilation or modification only within legal allowances.
11. Changes to the Service & Terms
11.1 We continuously improve the Service. Neutral improvements/extensions are permitted.
11.2 If changes lead to more than minor disadvantages for you, notice at least 6 weeks in advance; you may terminate extraordinarily at the change date.
11.3 Changes to these Terms will be notified by email. If you do not object within 6 weeks and continue to use the Service, they are deemed accepted; this will be pointed out. Significant changes grant a special termination right.
12. Statutory Warranty for Digital Services (§§ 327 ff. BGB)
12.1 We provide the Service in conformity with the contract and maintain functionality including required security and feature updates.
12.2 In case of defects, statutory rights apply (rectification, reduction/termination, damages per sec. 13).
13. Liability
13.1 Unlimited liability for intent/gross negligence, damages to life, body, health, and under mandatory law (e.g. Product Liability Act).
13.2 For slight negligence, liability only for breach of essential contractual obligations (cardinal duties), limited to foreseeable typical damages.
13.3 Limits also apply to our legal representatives, employees and agents.
14. Data Protection
Our Privacy Policy applies, available on the website. It provides information on purposes, legal bases, recipients, storage periods and your rights.
15. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Statutory rights remain unaffected.
16. Final Provisions
16.1 German law applies; mandatory consumer protection of your habitual residence remains unaffected.
16.2 Place of jurisdiction: statutory rules apply for claims against consumers; for claims against Senior Connect the place of jurisdiction is our registered office unless mandatory law states otherwise.
16.3 If any provision is invalid, the remainder remains valid; statutory provisions apply in place of the invalid one.
16.4 Contract language is German.
